Terms of service
This website and online store are operated by Adema L.L.C-FZ, a company registered in Dubai, United Arab Emirates, trading as Taken Jewellery ("TAKEN", "we", "us"). By visiting takenjewellery.com or placing an order, you agree to these Terms of Service, together with our Privacy Policy and Refund Policy, which form part of them.
Please read these terms carefully. If you do not agree to them, please do not use our website or place an order.
1. Using our website
You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. You agree not to use the site for any unlawful purpose, not to attempt to gain unauthorised access to it, and not to introduce any virus or other harmful code. We may refuse service or close an account at our discretion.
2. Products
Our jewellery is made in small runs using natural materials. Colour, grain and stone character vary slightly from piece to piece, and screen settings affect how colours appear online. Small variations of this kind are part of the product and are not defects. We try to describe and picture our products as accurately as possible, but we do not warrant that descriptions, images or other content are entirely error-free.
Product availability is not guaranteed. We may change or discontinue a product, or limit quantities of any product, at any time and without notice.
3. Prices and payment
Prices are shown in euro (EUR) unless another currency is selected at checkout, and may change at any time before you place an order. Prices exclude shipping, which is calculated at checkout, and exclude any customs duties or import taxes.
Payment is taken in full when you place your order. You confirm that the payment method you use is your own and that you have authority to use it. Orders may be cancelled by us if payment is declined or if we suspect fraudulent activity.
4. Orders
Your order is an offer to buy. Our order confirmation email acknowledges receipt of that offer; a contract of sale is formed when we dispatch the goods. We may refuse or cancel an order, for example if an item is out of stock, if a price or description was listed in error, or if we suspect misuse. If we cancel an order you have already paid for, we refund you in full.
5. Delivery and duties
Delivery timeframes shown at checkout are estimates and are not guaranteed. Risk in the goods passes to you on delivery. Orders shipped outside the United Arab Emirates may attract customs duties, import taxes or handling fees on arrival, which are your responsibility and are set by your local authority, not by us. Where an order is refused or unclaimed and returned to us, any shipping and duty costs incurred may be deducted from your refund.
6. Returns and refunds
Returns are governed by our Refund Policy, which forms part of these terms. In short: you have 30 days from delivery to request a return of unworn items in their original packaging, return shipping is paid by you unless the item was faulty, damaged or incorrect, and your statutory cancellation rights are unaffected.
7. Care and durability
TAKEN pieces are made to be worn every day, but they are jewellery, not equipment. Damage caused by wear and tear, accident, misuse, exposure to chemicals or perfume, or by repairs or alterations carried out by anyone other than us, is not covered. Manufacturing defects are covered under our Refund Policy.
8. Intellectual property
The TAKEN name, logo, designs, product photography, text and all other content on this site are owned by us or licensed to us and are protected by intellectual property laws. You may not reproduce, distribute or use them commercially without our prior written permission.
9. Reviews and content you submit
If you submit reviews, photos, comments or other content to us or tag us on social media, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that content in connection with our brand, and you confirm that it is your own and does not infringe anyone else's rights. We may edit or remove any content that is unlawful, offensive or misleading, but we are under no obligation to monitor content.
10. Third-party links and services
Our site may link to third-party websites and relies on third-party services, including Shopify for hosting and payment processing. We are not responsible for the content, policies or practices of third parties, and any dealings you have with them are between you and them.
11. Disclaimer and limitation of liability
Our website and products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we exclude all warranties not expressly set out in these terms, and we are not liable for any indirect, incidental or consequential loss, or for loss of profit, revenue or data, arising from your use of the site or our products.
Where we are found liable, our total liability to you is limited to the amount you paid for the order in question. Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded, including your statutory consumer rights.
12. Indemnity
You agree to indemnify us against any claim, loss or expense arising from your breach of these terms or your misuse of the site.
13. Privacy
How we collect and use your personal information is set out in our Privacy Policy.
14. Changes to these terms
We may update these terms from time to time by posting a revised version on this page. The version in force when you place an order is the version that applies to that order. Continued use of the site after a change means you accept the updated terms.
15. Governing law
These terms and any dispute arising from them are governed by the laws of the United Arab Emirates, and the courts of Dubai have jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer laws in your country of residence.
16. General
If any provision of these terms is found to be unenforceable, the remaining provisions stay in force. Our failure to enforce a right is not a waiver of it. These terms, together with our Privacy Policy and Refund Policy, are the entire agreement between us.
